Terms of Service

Welcome to Draft. These Terms of Service ("Terms") govern your use of the Draft applicant tracking system operated by Hubtal OU ("we", "us", or "our"). By using Draft, you agree to these Terms.

1. Description of Service and Access

Draft is an Applicant Tracking System designed to help companies manage recruitment processes effectively.

Free Access: The Service is provided primarily on a "Free-to-use" basis. Our free plan includes core features such as unlimited job postings, unlimited candidates, team collaboration, and a public careers page.

Premium Access: Certain advanced features may be available specifically to Premium (paying) users. Premium features include AI-powered candidate matching, advanced analytics, custom workflows, and priority support.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. You agree that Hubtal OU shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

2. Account Registration and Security

To use Draft, you must create an account and provide accurate, complete information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring that your account information is kept up to date

3. Acceptable Use

You agree to use Draft only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Post discriminatory, harassing, or misleading job listings
• Violate any applicable employment laws or regulations
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to send spam or unsolicited communications
• Interfere with or disrupt the Service or servers
• Collect or harvest user data without consent

4. No Warranty and "As-Is" Disclaimer

Please read this section carefully.

To the maximum extent permitted by applicable law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis. Hubtal OU expressly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Hubtal OU makes no warranty that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the use of the Service will be accurate or reliable
• Any errors in the software will be corrected

You understand and agree that:

• No Liability for Uptime: We do not guarantee any specific uptime. The Service may be unavailable due to maintenance, technical issues, or other reasons.
• No Liability for Bugs/Crashes: Hubtal OU is not responsible for any harm, loss of data, or business interruption caused by app crashes, bugs, delays, or technical malfunctions.
• Use at Own Risk: Any material downloaded or otherwise obtained through the use of the Service is done at your own discretion and risk.

5. Limitation of Liability

In no event shall Hubtal OU, its officers, directors, employees, or agents be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any:

• Errors, mistakes, or inaccuracies of content
• Personal injury or property damage resulting from your access to and use of our Service
• Unauthorized access to or use of our servers and/or any personal information stored therein
• Interruption or cessation of transmission to or from our Service
• Bugs, viruses, or other harmful code transmitted through the Service
• Loss of data or any damages arising from use or inability to use the Service

This limitation applies regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Hubtal OU has been advised of the possibility of such damage.

6. Candidate Data and Marketing Rights

You acknowledge that Draft operates on a model that allows us to assist candidates in finding employment opportunities.

6.1. Draft's Right to Contact

By using the Service, you acknowledge that any candidate who applies to your job postings through the Draft platform and consents to receiving marketing updates may be contacted by Draft regarding other job opportunities not associated with your company.

6.2. Exclusions to Contact

Draft will not contact candidates regarding other opportunities if they meet either of the following criteria:

• Recent Applicants: The candidate was added to the Draft system or applied to your job posting less than 30 days prior.
• Hired Candidates: The candidate has been explicitly marked as "Employed" (or an equivalent hired status) within the Draft system by you.

6.3. Premium User Opt-Out

If you are a subscribed Premium User, you have the option to disable this feature. If you opt out, candidates applying specifically to your company will not be prompted to opt-in to Draft's general marketing, or will be excluded from Draft's marketing communications regarding other opportunities.

7. User Responsibilities

• Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
• Data Accuracy: You agree to keep candidate statuses updated (e.g., marking hired candidates as "Employed") to ensure the proper functioning of the exclusion rules.
• Compliance: You agree to use the Service in compliance with all applicable local, state, national, and international laws, including data privacy laws (such as GDPR).
• Content Responsibility: You are responsible for all job postings, communications, and content you create within the Service.

8. Intellectual Property

Hubtal OU retains all rights, title, and interest in and to the Draft Service, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Service.

You retain ownership of the specific data and content you upload to the Service, subject to the rights granted to Hubtal OU regarding candidate marketing.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Effective Date" at the top.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

11. Governing Law and Jurisdiction

These Terms shall be governed by and defined following the laws of Estonia. Hubtal OU and yourself irrevocably consent that the courts of Estonia shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
